Terms and Conditions
1.
Sharia Reference: All
financial transactions at the Yakiin Charity Association Indonesia are based on
and subject to the principles of our true Islamic religion and our honorable
Sharia. The foundational guidelines for the Association’s practices are
clarified in a separate document that can be viewed on the website under the
title "Fundamental Regulations Guide of Yakiin Charity Association".
2.
Legal Reference:
These Terms and Conditions take into account the approved policies and
procedures regulating charitable and humanitarian work, as well as the laws and
regulations in force in the Republic of Indonesia. They serve as the reference
for regulating the legal relationship between the donor and Yakiin Charity
Association in a manner that guarantees the rights of all parties.
3.
Field Execution
Flexibility: Yakiin Charity exerts its utmost efforts to
direct and utilize donation amounts for the specific purposes and projects
designated by the donor, in accordance with applicable administrative and
Sharia policies. In the event that execution becomes impossible due to force
majeure or exceptional circumstances beyond Yakiin’s control, Yakiin has the
right to transfer the collected funds to another sponsorship or charitable
project that Yakiin deems fulfilling to the public interest and general
benefit.
4.
Accuracy of Personal
Data: The donor undertakes to provide their personal and
contact data clearly, correctly, and accurately through the electronic
platform. The donor alone shall be legally responsible for the validity of this
data and the consequences of any error therein.
5.
Anonymous or Erroneous
Donations: If the donor fails to provide their personal data or
submits it incorrectly, making it impossible to execute the donation according
to their specific choice, the donation shall be treated as an unconditional
general donation. Yakiin has the right to direct and allocate the amount to
charitable causes and projects most in need as it deems appropriate.
6.
Legality of Funds: The
donor acknowledges and confirms that the source of the donated funds is lawful
and acquired through legal means in compliance with local and international
anti-money laundering laws. The donor alone bears full legal responsibility
should the contrary be proven.
7.
Donation Errors and
Refund Window: In the event of an unintentional error
during the electronic donation process, the donor has the right to notify the
call center or technical support of Yakiin Charity Association Indonesia
through available official channels within (72) seventy-two hours from the time
of the transaction, to address the matter and look into refunding or modifying
the donation amount. After this period expires, the donor's right to claim any
modification or refund shall be forfeited.
8.
Nature of the
Contractual Relationship: The relationship between the donor and
Yakiin Charity Association is based on a developmental and humanitarian
contractual bond aimed at providing humanitarian, Quranic, and developmental
services to beneficiaries based on the objectives of Islamic Sharia (Maqashid
al-Shari'ah) in social solidarity.
9.
Major Projects: For
strategic or major projects, a separate and independent contract shall be
concluded between the donor and Yakiin Charity Association, encompassing all
project details, estimated budgets, timelines, and the detailed obligations of
both parties.
10.
Status of General
Donations: If no separate independent contract is concluded with
the donor, or if the donation is not allocated for a specific, narrow purpose,
the provisions of the general and unconditional donation terms contained in
this document shall apply to the submitted donation.
11.
Default on Pledges and
Sponsorships: If the donor commits to a financial pledge
or periodic sponsorship and fails to fulfill the payment of the remaining part
of the donation value for their project or sponsorship registered in their
name, and the default continues for a period of up to three months from the due
date of the installment, Yakiin Charity Association has the right to transfer
the previously paid amounts to another sponsorship or project it deems
fulfilling to the humanitarian interest, in order to avoid disrupting the
project.
12.
Administrative and
Operational Deductions: Yakiin Charity Association deducts a
specific, legally and administratively approved percentage from the donation
amount, not exceeding 12.5%, to cover the costs of fund transfers, currency
exchange differences, project operations, and spending on supervision and
follow-up management by technicians and engineers. All of this is in compliance
with Sharia regulations and the approved standards for "those employed to
administer them" (Amil). Yakiin constantly strives to reduce this value to
the minimum possible limit to maximize the impact of the donation.
13.
Surplus Project Funds: In
the event of a financial surplus or realized savings in the project funds after
its full completion, Yakiin Charity Association may manage these savings and
direct them to similar projects or general avenues of righteousness, achieving
the Sharia objective and the best interest of the beneficiaries.
14.
Force Majeure and
Project Environment Changes: Joint coordination will
take place between Yakiin and the donor if Yakiin is forced to change the venue
or destination of the donation due to force majeure or emergency and security
circumstances that may prevent or hinder the continuation of the project in the
pre-defined environment. If no response or objection is received from the donor
within 30 days from the date of notification, this shall be considered an
implicit approval of the alternative measure taken by Yakiin Charity
Association.
15.
Privacy and
Confidentiality of Data: The platform is committed to applying
the highest standards of strict protection and confidentiality to preserve the
private data of donors. It undertakes not to disclose or share it with any
external institutions or entities, except within the limits required by
applicable laws and regulatory rules, or upon an official request from judicial
and competent authorities.
16.
Impact Assessment and
Sustainability Budget: Yakiin Charity Association may deduct a
certain percentage of donations directed for the purposes of impact
measurement, evaluation, and independent verification of the efficiency and
sustainability of charitable projects in the field to ensure the quality of
work.
17.
Modification or Removal
of Project Media Materials: Yakiin Charity Association retains the
full right to modify, update, or remove the project sign or its associated
reports if their continued publication would harm the safety and security of
the beneficiaries or their human dignity, or negatively affect the
institutional reputation of charitable work.
18.
Acknowledgment and
Electronic Agreement: By clicking the donation button or
completing the financial transaction via the website of Yakiin Charity
Association (ykiin.org) or through any of its official communication channels,
the donor acknowledges that they have reviewed all of these general terms and
conditions, understood their contents, and fully and irrevocably agreed to
them.
